ARTICLE 1: PURPOSE 

 

Article 1.1: The Contract

The purpose of these Conditions is to define the terms of sale between Yello Market and the Customer, from the order, to the services, to the payment and delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties on the website www.yellomarkets.com.

These general conditions of sale are the only ones applicable and replace all other conditions, unless otherwise agreed in advance, expressly and in writing.

Yello Market reserves the right to adapt or modify, at any time, these General Terms and Conditions of Sale.

Any modifications of these general terms and conditions of sale are enforceable as from their publication online.

Article 1.2: Definition

The Internet user refers to any natural person visiting the Site.
The Customer refers to any natural person visiting and making a purchase on the Site.

 

Article 1.3: Capacity

The Internet user and/or the Client declares that he/she has the capacity to enter into this Agreement, i.e. to have reached the age of legal majority and not to be under guardianship or tutelage.

 

Article 1.4: Destination

The Customer declares that she does not purchase Yello Market products and articles with a view to reselling them.

To ensure the availability of our products to all our customers, particularly during promotional offers, Yello Market reserves the right to refuse to honour all or part of an order deemed abnormal, in particular with regard to the quantities of products usually ordered by a consumer.


 
ARTICLE 2: OUR OFFER 


Article 2.1: www.yellomarkets.com is a site whose purpose is to offer ready-to-wear items and fashion accessories for sale. The products and articles offered for sale are described and presented with the greatest possible accuracy.

 

Article 2.2: All offers of products and articles, as well as the terms of delivery are valid in metropolitan France, Dom TOM and Corsica.

 

Article 2.3: Yello Market may, in particular because of its suppliers, be required to offer the Internet user products and articles with a composition slightly different from that described, but in any case of quality equal to or better than the product or article ordered. In this case, if the replacement products and articles, once received by the Customer did not suit her, the postal return costs would be covered by Princess Boutique.

 

 
ARTICLE 3: AVAILABILITY 


The offers of products and articles are valid as long as they are visible on the site and only for the duration of the operations.

Upon receipt of the order by the Internet user, Yello Market will check the availability of the product(s) and item(s) ordered.

In the event of temporary unavailability, Yello Market undertakes to do so within 30 days of validation of the order, and after agreement by the Customer:

    Either to deliver the ordered product to the Internet user,
    Either to repay it.

In any case, Yello Market undertakes to inform any Internet user who has placed an order for an unavailable item. In the event of a permanent shortage of stock on one of the products or articles of the order, the order placed will lapse without compensation on either side.

The customer will then be contacted and will have the opportunity to either:

    To be reimbursed,
    To place his order again without the item in stock.



ARTICLE 4: OUR PRICES 

 

Article 4.1: Prices

The prices of the products and articles on the Site are indicated in Euros all taxes included and take into account the French VAT in force on the day of the order. The prices indicated on the Site are only valid for sales made on the Site.

They are guaranteed subject to typographical or printing errors.

These prices do not include a flat-rate contribution to the shipping costs in effect on the day of the order.

Yello Market reserves the right to modify the prices at any time but undertakes to apply the prices in force at the time the order is validated by the Customer.

If one or more taxes are created or modified upwards or downwards, this change may be reflected in the selling prices of the products and sales documents.

 

Article 4.2: VAT

The VAT included is the French VAT at the rate in force on the day the order is validated for the products and articles concerned. If the VAT rate is modified, these changes may be reflected in the prices of products and articles, without the Internet user being informed in advance.

 

 
ARTICLE 5: ORDER 


Any order implies acceptance of the prices and description of the products and articles available for sale on the Site.

 

Article 5.1: Creating a user account

Before the Customer can place her order, she must create a user account.
This account will allow him to make his purchases and follow the progress of his orders.

The Client must necessarily complete a form, containing the following information: title, surname, first name, full delivery and invoicing address, e-mail address and telephone number.

This information is necessary for the order to be recorded and shipped.

 

Article 5.2: Order and order tracking

 

Article 5.2.1: The steps of the order

The order is processed in five steps: Validation of the basket, Information necessary for delivery, Validation of the order and payment, Confirmation of the order: registration date, Sending of the order.

For a better follow-up of her order, the Customer can identify herself on the Site by entering her login details (e-mail and password).

 

The Internet user interested in a product or article visible on the Site follows the following process in order to establish his online order:

    Basket validation:

After having clicked on the "add to your basket" icon and after having verified the specificities of his order (product, quantity, price, size, etc.), the Internet user validates the choice of the selected product (s) or article (s) by clicking on "validate my basket".

    Information necessary for delivery:

The Customer completes all the information necessary for delivery, then chooses his mode and place of delivery.

    Validation of the order and payment:

The Customer has a summary of her order, the amount of the order, the shipping costs and the place where she wants to be delivered. The Customer then chooses her payment method and registers her order.

Once the order has been registered and the payment step has been validated, an email is sent to the Customer, summarizing all of her order and confirming that the order has been taken into account. This is for information purposes only.

    Confirmation of the order: registration date

Following the first email, an email confirming the order will be sent to the Customer.
From then on, the order is validly recorded. The delivery period starts from this date.

    Sending the order:

In the days following the confirmation of her order, the Customer receives an order summary e-mail indicating that the package has been shipped.

    Retraction :

The customer has 14 days to cancel his order altogether. To do this, simply make an explicit request through the contact form. The order will be refunded within 10 days.

 

Article 5.3: Order Archiving

Orders are archived on our server. At any time, the Customer can access the details of her orders by contacting Yello Market.


 
ARTICLE 6: PAYMENT 


The Internet user has the option of paying by credit card by simply entering the code appearing on it directly on the site. Yello Market has put in place the technical means necessary to secure orders and related payments made on its site by the Internet user.

 

Article 6.1: Payment by credit card on the site

When validating his order, the Internet user provides the number of his credit card associated with the expiry date and the cryptogram consisting of the last three digits on the back of the card.


Article 6.2: Default of Payment

Yello Market reserves the right to refuse to make a delivery or to honour an order from an Internet user who has not fully or partially settled a previous or current order or with whom a dispute is being administered until a solution to this dispute has been found.
 

 
ARTICLE 7: SECURITY OF PAYMENTS 

 

Article 7.1: Secure payment

When the Internet user pays by credit card, he is asked at the end of the order to indicate his card number, the validity date and the last three digits on the back of the card. Different accesses to authorization distributors are then made in order to verify the data to avoid abuse and fraud. To do this, the server is in encrypted mode and all the information transmitted is encrypted. None of this data is transmitted unencrypted over the Internet.

In all cases, the online provision of his card number and the final validation of his order shall be deemed proof of the integrity of the order and the enforceability of the sums due in execution of the said order.

This validation constitutes express acceptance of all operations carried out on the Site.

 

Article 7.2: Safety devices

In order to ensure the security of payments, the site uses the secure payment service. This service integrates the SSL security standard.

Confidential data (16-digit credit card number and expiry date) are directly transmitted encrypted on the server without passing through the server's physical media.

When the order is validated, the payment request is routed in real time to the secure telepayment manager. The latter sends a request for authorization to the credit card network. The telepayment manager issues an electronic certificate.

Yello Market checks all orders that have been validated on the site. These controls are intended to protect Yello Market and its customers from abusive practices by fraudsters.

For an order that has a delivery address different from the billing address, Yello Market services may contact the two persons mentioned; namely, the person attached to the billing address and the person indicated for the delivery address.

As part of these procedures, these services may require the Internet user to provide all the documents necessary to unblock his order: proof of residence and debit in his name, but also proof of residence in the name of the person indicated for the delivery address, etc. These requests are made by e-mail, then by mail with AR.

The information provided in the purchase order is subject to automated data processing. The purpose of this automated data processing is to define a level of analysis of a transaction and to fight against credit card fraud.

The non-transmission of data by the Internet user on the order form prevents the execution and analysis of his order.

The occurrence of an unpaid due to fraudulent use of a credit card will result in the registration of the details of the order form associated with this unpaid within a payment incident file. An irregular declaration or an anomaly may also be subject to specific processing.

In accordance with the Data Protection Act of 6 January 1978, the Internet user has the right to access, rectify and oppose all personal data at any time, by writing by e-mail and providing proof of identity to : Service@yellomarkets.com.

 
 
ARTICLE 8: DELIVERY 


To be delivered, the Internet user has the free choice between home delivery, delivery to his workplace or to any other address of his choice stipulated at the time of ordering.

At home or at any other address: If the Internet user is absent then a notice is left in his mailbox if necessary.

 
Article 8.1: Delivery times

The order is sent to the Internet user by the Post Office within 2 to 3 working days, except in cases of force majeure which would delay delivery. Please note that any orders placed after Friday 12:00 noon will only be sent from Monday of the following week. This time may be extended by 2 days during sales periods or any other promotional operation. If a delay is likely to occur in the delivery, Yello Market undertakes to notify the Internet user as soon as possible. Yello Market will then contact the postal services in order to open an investigation, it being specified that the time required for a postal investigation may be long. In the event of a prolonged delay in delivery, the Internet user is invited to report it as soon as possible to Yello Market customer service using the telephone number indicated in the order confirmation email.

In the event that delivery times are exceeded by more than 10 days from the scheduled delivery date, the Client is entitled to cancel her order.
 
Article 8.2: Delivery Charges

For each order, the Internet user is required to pay a flat-rate contribution to the delivery costs (postage, packaging, etc.) of:

    1.99 € up to 39.70€ of products to be invoiced with Mondial Relay & So Colissimo Merchant
    Beyond 15€ of invoiced products, shipping costs are offered with Mondial Relay.
    3.99€ up to 39.70€ with So Colissimo Domicile

 

Article 8.3: Preparation Costs

For each order, the Internet user is required to pay a flat-rate contribution to the preparation costs (preparation of the package, etc.) of: the order preparation costs are invoiced at €3.99.


 
ARTICLE 9: RESERVATION OF OWNERSHIP CLAUSE 


The products remain the property of Yello Market until full payment of the order price has been received. However, as soon as the order is received by the Internet user or at the point of sale chosen by the latter, the risks of the goods delivered are transferred to the Internet user.

 

ARTICLE 10: RETURNS AND REFUNDS 

 

Article 10.1: Satisfaction Guarantee

Items ordered on the Site may be exchanged for a credit note or refund, unless otherwise stated.
Indeed, the Internet user can return items delivered defective or that would not provide any satisfaction.


Article 10.2: Return Mode

Return procedure, procedure to follow:

For a better treatment of your request, we invite you to put the invoice and the return form in the package.

Sent by post only, the return with Mondial Relay is not supported (for reasons of delivery time, reliability and speed).

As soon as we receive your package, a voucher for the amount of the products will be sent to you by e-mail or the refund will be made by bank transfer.

WARNING! Yello Market does not exchange items (our items are very successful, we cannot guarantee to have the item in stock during the time of receipt of your package), please place your order again on our website or wait for your purchase order which will be sent to you by email after processing the package.

 

Preparation of the package:

    Pack the item(s) to be returned in the original packaging.
    Slide the invoice of the order and the return form into the package.

IMPORTANT: you have 30 days of withdrawal period to return your products to us from the date of receipt. Your product return will be processed within 10 days of receipt of your package at our premises. You are responsible for the return shipping costs.

 Items returned incomplete, damaged, damaged, deteriorated or soiled by the
customer will not be refunded or exchanged. If you would like us to return the
articles, you will be asked to pay the processing fee of 20€. Your articles will be
kept for one week. After this time the items will be destroyed and you will no longer be able to
to ask.

For reasons of hygiene, Yello Market does not accept returns of unsealed or worn accessories for the categories: lingerie, earrings and swimwear).
 

 
ARTICLE 11: SIGNATURE AND PROOF

 

For any payment by credit card on the Site, the electronic certificate issued by the telepayment manager shall be proof of the amount and date of the transaction, in accordance with the provisions of Articles 1316 et seq. of the Civil Code.

The computerized records, kept in Yello Market's computer systems, will be considered as proof of communications, orders and payments between the parties.


In this respect, the dates and times of the server will be binding between the parties.

 
 
ARTICLE 12: LIABILITY 


Yello Market cannot be held liable for the non-fulfilment of the order concluded, due either to the Customer's fault or to the unforeseeable and insurmountable fault of a third party to the contract, or to the occurrence of an event of force majeure and in particular, without this list being exhaustive, in the event of disasters caused by floods or fires.

Yello Market cannot be held liable for any inconvenience or damage inherent in the use of the Internet network and totally outside the due diligence and precautions taken by Yello Market.
In particular, Yello Market cannot be held liable for any disruption in the provision of the service or any external intrusion or presence of computer viruses.

In the event of a complaint of any nature whatsoever from the Customer about an order (e.g. non-delivery of an order or part of an order), the Customer has a maximum of 30 days from the date of the provisional delivery term of the order to contact Yello Market. Beyond this period, no claims will be accepted, with the exception of the legal guarantee of compliance provided for by law. In the event of such a claim, if the repair or replacement of the ordered item is impossible, the cost of returning the item by parcel post will be borne by Yello Market.

Similarly, any event qualified as force majeure, within the meaning of the case law of the Court of Cassation, totally exonerates Yello Market from any liability.

 
 
ARTICLE 13: PERSONAL DATA


The collection of the Internet user's personal data is necessary to take into account his order.

By indicating his e-mail, he will receive a confirmation of his order, but also information on promotional offers from Yello Market as well as on events via the Internet In accordance with the Data Protection Act of 6 January 1978 amended by the Act of 6 August 2004, the Internet user has a right of access and rectification to information concerning him. ARTICLE 14: INTELLECTUAL PROPERTY 


Yello Market is the owner of the rights to the texts, the general architecture, the animated or still images, the graphics and sounds and more generally to all the content of the Site.

In accordance with Article L122-4 of the Intellectual Property Code, any representation or reproduction, in whole or in part, of the content made, by any means whatsoever, without the consent of Yello Market is unlawful. The same applies to translation, adaptation or transformation, arrangement or reproduction by any art or process.

The violation of the provisions of Article L122-4 of the Intellectual Property Code constitutes an infringement within the meaning of Article L335-2 of the same code, which constitutes an offence.

Nothing in these General Terms and Conditions of Sale and Use shall be construed as granting the Internet user any right of any kind whatsoever to the elements protected by intellectual property, of which Yello Market may have ownership or exclusive right of exploitation.

In any event, any link, even tacitly authorized, must be removed at the request of Yello Market.


 
ARTICLE 15: INTEGRAL NATURE OF THE CONTRACT 


These General Terms and Conditions of Sale concluded between Yello Market and the Internet user express all the rights and obligations of the parties.

No document, indication or correspondence may create obligations under these General Terms and Conditions of Sale unless they are the subject of an amendment signed by both parties.

If a particular provision of these General Terms and Conditions of Sale is held to be invalid or declared as such by a decision having the force of res judicata of a competent court or if one of the clauses of these Conditions would be null and void by a change in legislation or regulations, the other provisions shall retain all their force and scope.

This shall in no way affect the validity of and compliance with these General Terms and Conditions of Sale.


 
ARTICLE 16: DISPUTES 


Any legal action shall be brought before the competent courts of the defendant's domicile.
These General Terms and Conditions of Sale are subject to French law.

 
ARTICLE 17: PRODUCT WARRANTY


The products have a 1 year warranty according to the legal provisions in force.
